A Changing Area of the Law
The areas of the law that deal with probate, estate planning, incapacity and end-of-life issues are in a near-constant state of flux. Because of that, revisiting your estate plan at least every few years is recommended to ensure that the plan you have is a plan that will hold up legally when the time comes. Similarly, as the value of your assets changes, your estate plan may need to be changed as well.
Attorneys at our firm take the time and make the effort required to stay on top of important changes in the law. One such change that Californians who own property should be aware of involves the federal estate tax. For 2008, the exclusion amount is $2 million — beyond that, the federal estate tax kicks in. In 2009, the exclusion will rise to $3.5 million. In 2010, no exclusion limits will apply. The problem arises in 2011, when the estate tax exclusion is scheduled to be set at only $1 million. That fact, combined with the high value of California real estate, makes careful planning now essential.
